On-Site Septic System Inspection Agreement

This agreement ("Agreement") is made and entered into on the date of electronic signature below, by and between the undersigned Customer and NY Environmental Septic Inspections, Inc. ("Inspector"), for the inspection services selected below at the property address below.

What's included — Tier 1: Comprehensive Functional Inspection
  • Locating & Access: Verification of tank location using provided existing map profiles. If no maps or plans are provided, the tank will be located via camera scoping or transmitters for an additional fee.
  • Structural Integrity Assessment: Comprehensive evaluation of tank material, lids, seams, and baffle conditions.
  • System Flow & Load Test: Stress-testing the absorption area via controlled interior/exterior water volume to ensure proper drainage.
  • Surface Absorption Area Survey: Physical probe and evaluation of the leach field surface for saturated soils or failure signs.
  • Transparent Digital Reporting: Complete emailed report by end of day including all photos, an updated location map, and a brief real-time overview video clip.

Fee: $595.00 plus applicable county tax.

What's included — Tier 2: Premium Diagnostic Inspection

Insulates buyers from hidden, multi-thousand-dollar underground pipe/system failures.

  • Includes everything in the Tier 1 package.
  • Inlet Line Video Scope: Push-camera diagnostics from the house to the septic tank to check for root intrusions, structural bellies, or collapsed lines.
  • Outlet Line Video Scope: Camera tracking from the tank to the distribution box/absorption field entry point.
  • Full Video Log: High-definition video files of all pipe interiors attached directly to the final digital report.
  • Absorption Area Soil Test: Hand-dug soil evaluation at the absorption area to assess soil composition, depth to restrictive layers, and evidence of saturation (this is a diagnostic soil evaluation, not a percolation test).

Fee: $695.00 plus applicable county tax.

What's included — Well Inspection

A stand-alone functional and mechanical evaluation of a private drinking water well and its equipment, commonly ordered alongside a septic inspection for real estate transactions on properties served by a private well.

Please note: this is a functional and flow evaluation, not a water quality test. Inspector does not collect or process water samples. Customers who want bacteria, nitrate, or other water quality analysis should arrange that separately through a certified laboratory.

  • Well Head & Casing: Exterior evaluation of the visible well casing, well cap or seal, venting, and the grade surrounding the wellhead for signs of damage, improper sealing, or potential surface water intrusion.
  • Pressure Tank & Controls: Inspection of the pressure tank, pressure switch, gauge, air charge and bladder condition, accessible wiring, and related control components.
  • Pump Operation & Cycling: Observation of the pump through a complete cycle, including cut-in and cut-out pressures, and evaluation for short-cycling or other operational defects.
  • Visible Plumbing & Equipment: Inspection of accessible supply piping, fittings, shut-offs, and any visible water treatment equipment. Treatment equipment is documented as present; its performance is not evaluated.
  • Flow Rate & Yield Test: A controlled draw-down test measuring sustained delivery in gallons per minute over a timed run, with recovery observed, to evaluate whether the well can meet typical household demand.
  • Transparent Digital Reporting: A complete report emailed by end of day, including photographs, the measured flow rate, and all findings and recommendations.

Fee: $350.00 plus applicable county tax when performed as a stand-alone service.

Package Deal: Tier 2 + Well Inspection — $995.00. When a Tier 2 Premium Diagnostic Inspection and a well inspection are both performed at the same property, the combined price is $995.00 plus applicable county tax — a $50.00 savings off the individual prices of $695.00 and $350.00. Package pricing applies when both services are booked together and performed during the same scheduled visit. Field fees and add-on charges described in Section 5 apply separately.

What's included — Complete Septic System Layout & Mapping (by appointment)

Our most comprehensive inspection. In addition to a full functional evaluation, this service provides a complete layout and documentation of your septic system, creating an accurate, up-to-date "blueprint" of all accessible components. Ideal for homeowners, property buyers, contractors, and anyone looking to fully understand the design and condition of their septic system.

  • Locating & Access: Verification of the septic tank location using existing as-built plans or maps provided by the client. If no plans are available, the tank can be located using camera scoping or electronic locating equipment for an additional fee.
  • Structural Integrity Assessment: A comprehensive evaluation of the septic tank, including the tank material, lids, seams, and inlet and outlet baffles.
  • System Flow & Hydraulic Load Test: A controlled hydraulic load test to evaluate the system's ability to accept and process wastewater under normal operating conditions.
  • Surface Absorption Area Survey: Inspection of the leach field surface for signs of saturation, settlement, or other indicators of potential failure.
  • Distribution Box Evaluation: All accessible distribution boxes are uncovered, opened, inspected, and documented to verify proper flow and distribution throughout the system.
  • Leach Field Camera Inspection: Every accessible leach field lateral is camera scoped and evaluated for structural condition, obstructions, root intrusion, standing wastewater, or other defects.
  • System Measurements & Mapping: Measurements of all accessible septic components, including tanks, distribution boxes, junction boxes, and leach field laterals, to create an accurate, up-to-date system layout.
  • Updated Septic System Blueprint: A detailed digital layout identifying the location and configuration of all accessible septic components, included with the final report for future reference, maintenance, or repairs.
  • Transparent Digital Reporting: A complete inspection report emailed by end of day, including photographs, an updated septic system layout, measurements, camera footage (where applicable), and a brief video overview summarizing the findings.

2. Inspector Services

a. Inspection. Inspector shall inspect the Customer's septic system based on a visual inspection of the readily accessible components, including (1) buried septic tank(s), (2) drain fields, and (3) soil absorption systems. The inspection begins only after the system is located.

b. Consultation with Inspector. Inspector shall inform Customer of any unique problems or recognized potential hazards found during the inspection. If compromised or damaged conditions are found, Inspector will consult with Customer to explain the issue and make recommendations for possible repair.

c. Issuance of Report. Upon completion of the inspection, Inspector shall issue an Inspection Report based on the visual inspection and information provided by the Customer, reflecting the present condition of the system at the time of inspection.

3. Customer's Duties and Responsibilities

a. Customer agrees to provide:

  • Access to the property and septic system to be inspected;
  • A safe work environment; and
  • Reasonable safety precautions to protect against personal injury, death, and property damage.

b. Notice of Defects. Customer shall provide prompt notice to Inspector of any known defect, fault, or default in the septic system prior to inspection, and should ask the property owner about any prior repairs. Customer shall provide Inspector with any maintenance, service, or inspection records in Customer's possession.

c. Hazardous Materials or Conditions. If hazardous conditions are encountered, Inspector shall have no obligation to continue work in the affected area until it has been made safe by Customer, as certified in writing by a qualified independent testing agency, at Customer's expense. Customer shall indemnify and hold Inspector harmless for any damages resulting from exposure to hazardous conditions, whether or not Customer pre-notified Inspector of their existence.

4. Pre-Inspection Checklist & Payment Terms

To ensure a smooth inspection process and avoid delays, please review the following:

  • Water/Power Requirements: Utilities must be active. If interior access is unavailable, a functioning exterior hose spigot must be accessible.
  • Property Access: A representative must be present to run water from interior fixtures during the flow test, unless an exterior spigot is cleared for use.
  • Credit Card on File: A valid credit card is required to secure the appointment window. The card will not be charged until the inspection is completed, except as described in the Cancellation & Rescheduling Policy below.
  • Report Release: Final digital inspection reports, videos, and maps will be emailed following successful invoice payment.

5. Compensation & Fees

a. Service Fee. Customer shall pay the fee for the service package selected in Section 1, plus applicable county sales tax, due at the date and time of inspection. Package fees apply only when the included services are performed as described in Section 1; if an included service is cancelled, rescheduled separately, or cannot be performed, the remaining services are billed at their individual rates. The field fees below apply in addition to the package fee unless Section 1 states they are included. For purposes of Section 6, the "selected service package fee" means the fee of the package selected in Section 1.

b. Additional Systems. If there are multiple septic systems on the property, Customer will pay an additional inspection fee of $400.00 per each additional system, unless a multi-system package is selected in Section 1.

c. Locating the OWTS. If the Customer does not know the precise location of the on-site wastewater treatment system (OWTS), locating the tank from the interior waste line via camera or electronic locating transmitter is available for an additional $100.00.

d. Excavation / Digging. Digging to a depth greater than 1 foot to access a tank lid is an additional $125.00. If the lid is buried 3 feet or deeper, Customer will need to arrange for mechanical excavation; Inspector will return to complete the inspection once the lid is accessible.

e. Outlet Lid Replacement. A $40.00 fee applies for a replacement outlet lid if the existing lid is missing, damaged, or susceptible to damage. Inspector carries spare lids on hand; this fee covers the cost of the replacement lid. Opening this lid also allows Inspector to scope the outlet line to the absorption area.

f. Access Limitations (Tier 2). If Tier 2 service is selected and the tank or outlet lids are inaccessible beyond reason, Inspector will not damage or destroy property — including patios, driveways, pools, fencing, or other obstructions — to gain access.

g. Nonpayment Remedies. Failure to make payment in accordance with this Agreement is a default. In the event of non-payment, Customer shall be required to pay a $50.00 administrative late fee and all attorneys' fees incurred to collect the debt. Inspector shall also have the right to (1) withhold services, including issuance of the Inspection Report, (2) terminate this Agreement, and (3) retain all deposits, fees, and payments already made by Customer. These remedies are in addition to any other remedy available to Inspector at law or in equity.

6. Cancellation & Rescheduling Policy

Because Inspector reserves dedicated multi-hour time slots and transports diagnostic equipment for each appointment, unexpected cancellations significantly impact scheduling. By signing below, Customer agrees to the following cancellation terms:

  • More than 48 Hours Notice: No fee. Full flexibility to reschedule.
  • 24 to 48 Hours Notice: Cancellations or rescheduling requests made within this window will incur a charge equal to 50% of the selected service package fee. If the cancellation is due to an emergency and rescheduling is requested, the 50% charge will be applied toward the full price of the completed inspection.
  • Same-Day Cancellation / No-Show: Cancellations made on the day of service, or instances where the technician arrives but cannot perform the work due to lack of utility access or site preparation, will incur a charge equal to 100% of the selected service package fee.

7. Insurance, Indemnification & Limitation of Warranties

a. Inspector's Insurance. Inspector shall maintain general liability insurance in a commercially reasonable amount. Customer acknowledges that the current homeowner must maintain, and will maintain for the duration of this Agreement, a policy of property insurance covering property damage and liability claims, and will provide evidence of such upon request.

b. Waiver Regarding Injury and Damages. Customer waives all claims against Inspector, and agrees to indemnify, defend, and hold Inspector harmless, for injuries or damages that Customer or any of Customer's family or invitees may suffer while on or around the property during the inspection.

c. Indemnity by Customer. Customer acknowledges that Inspector is serving only to inspect the septic system. Inspector will not perform excavation work to locate the system, nor dig past 3 feet to locate the system. Customer agrees to indemnify and hold Inspector harmless with regard to any claims, costs, obligations, or liabilities incurred by Inspector in connection with the inspection.

d. No Warranty. Neither Inspector nor the Inspection Report constitutes a warranty, express or implied, regarding the adequacy, performance, or condition of any structure, system, or item. Conditions are subject to change after the inspection occurs. The Inspection and Inspection Report are not intended to reflect property value or to make any representation as to the advisability of purchase or suitability of use, and reflect only the opinion of Inspector based on a visual inspection of readily accessible areas and information supplied by Customer at the time of inspection.

e. Confidentiality. The Inspection Report and all information attached to it are for the Customer's use only. Sharing any information in the report is at the Customer's discretion.

f. Regulatory Reporting. Inspector is obligated to report findings to the Local Health Department for systems that could impact public health.

8. Client Authorization & Card on File

I authorize NY Environmental Septic Inspections, Inc. to secure my booking with a credit card on file and to perform the inspection services selected above at the property address listed above. I understand and accept the potential field fees described in Section 5, applicable sales tax, and the cancellation policy described in Section 6. I authorize the card on file to be charged accordingly upon completion of service or per the Cancellation & Rescheduling Policy described in Section 6.
